Welcome to MOKO.
These Terms of Service (“Terms”) govern your access to and use of our website, online store, products and related services (collectively, the “Services”).
Our online store is powered by Shopify, which provides the e-commerce platform that enables us to offer our products and Services to you.
By accessing our website, browsing our store, creating an account or placing an order, you agree to these Terms and our Privacy Policy.
If you do not agree with these Terms, please do not use our Services.
1. Access and Account
By using our Services, you confirm that you are legally capable of entering into a binding agreement under the laws applicable to you.
You agree to provide accurate, current and complete information when creating an account, placing an order or otherwise using our Services.
You are responsible for maintaining the confidentiality and security of your account credentials and for activity carried out through your account.
You may not use our Services for any unlawful or unauthorized purpose.
2. Our Products
We make every reasonable effort to display and describe our products accurately, including their colours, materials, dimensions and features.
However, colours and appearance may vary slightly depending on your device, screen settings, lighting and photography.
Because some MOKO products may involve textile materials, small-batch production or handmade elements, minor variations in texture, pattern placement, stitching or appearance may occur and do not necessarily constitute a defect.
Product descriptions, specifications, availability and pricing may be updated from time to time.
We reserve the right to discontinue products or limit quantities available for purchase.
3. Orders
When you place an order, you are making an offer to purchase the selected products.
An order is considered accepted once we confirm and process it.
Please review your order carefully before completing your purchase.
Orders may be cancelled within 1 hour after they are placed. After this 1-hour cancellation period has passed, we may begin processing your order and cancellation may no longer be possible.
If you wish to cancel your order within the cancellation period, please follow the cancellation option available through our store or contact us as soon as possible.
If an order has already been processed or dispatched, it cannot be cancelled. However, you may still be eligible to return the item in accordance with our Return & Refund Policy and your applicable statutory consumer rights.
We reserve the right to refuse or cancel an order where reasonably necessary, including in cases involving payment problems, suspected fraud, incorrect pricing or product information, stock availability errors, shipping restrictions, or other circumstances that prevent us from fulfilling the order.
If we cancel an order after payment has been received, the relevant amount will be refunded using the original payment method.
4. Prices, Taxes and Payment
Prices displayed on our website are shown in the currency applicable to the selected market or checkout.
The final amount payable, including applicable taxes and any shipping charges calculated by us, will be displayed before you complete your purchase.
For international orders, customs duties, import taxes or other charges imposed by the destination country may apply. Where such amounts are not collected by us at checkout, they may be payable by the customer upon import or delivery.
We reserve the right to change prices at any time. Price changes will not affect orders already accepted by us.
You agree to provide valid and authorized payment information.
Payment processing may be provided by Shopify and/or third-party payment providers.
5. Shipping and Delivery
Shipping costs and estimated delivery times vary depending on the destination country and the shipping method available for your order.
The applicable shipping cost and available delivery options will be displayed at checkout before you complete your purchase.
Delivery times are estimates unless expressly stated otherwise and may vary depending on the destination.
Delivery may be affected by circumstances outside our reasonable control, including carrier delays, customs processing, weather conditions, public holidays and other unforeseen events.
Customers are responsible for providing a complete and accurate delivery address.
Nothing in this section limits any mandatory consumer rights relating to delivery, loss or damage in transit.

6. Returns and Refunds
MOKO offers a 30-day return period, meaning you may request a return within 30 days after receiving your order, subject to the eligibility requirements set out in our Return & Refund Policy.
Returned items must meet the conditions specified in our Return & Refund Policy.
The 30-day return period is separate from the 1-hour order cancellation period described above.
Nothing in our voluntary 30-day return policy limits any mandatory consumer rights available under applicable law.
If you are a consumer in the European Union, you may also have a statutory 14-day right of withdrawal for eligible distance purchases, subject to applicable exceptions. Our 30-day return policy provides an additional period beyond this statutory minimum, subject to the conditions stated in our Return & Refund Policy.
7. Faulty or Non-Conforming Goods
If an item is defective, damaged, incorrect or otherwise does not conform to the sales contract, you may have statutory rights in addition to our voluntary return policy.
For consumers in the European Union, sellers are generally responsible for lack of conformity existing at delivery and becoming apparent within the applicable legal guarantee period, which under EU rules is at least two years.
Please contact us as soon as reasonably possible if you believe there is an issue with your order.
We may request photographs or other reasonable information necessary to assess the issue.

Use of our website for personal, non-commercial purposes does not transfer any intellectual property rights to you.
9. Third-Party Services and Links
Our website may contain links to or integrations with third-party websites, payment providers, social media platforms or other services.
We are not responsible for the content, availability, privacy practices or independent services of third parties.
When you use a third-party service, that provider's own terms and policies may apply.
10. Relationship with Shopify
Our online store is powered by Shopify.
Shopify provides the technology and infrastructure used to operate our online store.
However, products purchased through our store are sold by MOKO, and your purchase relationship is with MOKO rather than Shopify.
Certain features or services provided through Shopify may also be subject to Shopify's own terms and privacy practices.
11. Privacy
Personal information collected through our Services is handled in accordance with our Privacy Policy.
Because our store is hosted by Shopify, certain information may also be processed by Shopify and other service providers necessary to operate the store, process payments, fulfil orders and provide related functionality.

12. Reviews, Feedback and User Content
If you voluntarily submit reviews, photographs, comments, suggestions or other content to MOKO, you confirm that you have the right to submit that content.
You must not submit content that:

contains malicious code;

otherwise violates applicable law.
Where permitted by law, you grant MOKO permission to use voluntarily submitted reviews and feedback for purposes connected with operating, improving and promoting our business and products.
13. Errors and Inaccuracies
Occasionally, information on our website may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, availability, shipping charges or delivery estimates.
We reserve the right to correct errors and update information where reasonably necessary.
If an error materially affects an order already placed, we will take appropriate steps and, where required, contact you regarding the available options.

If you are a consumer located in the European Union or European Economic Area, you may benefit from mandatory consumer protection rights.

If you are a consumer, nothing in this section deprives you of any mandatory protection or right to bring proceedings before a competent court where such right is provided by applicable law.
